hereby known as Renter, agree to rent from, Susan Reep, hereinafter known as Owner, the Vacation Property located at 10667 Conifer Lane, Alta Sierra, CA 93285. In this agreement, "you" and "your" refer to Renter and "we" and "our" refer to Owner.
PAYMENTS
The Owner accepts Visa, MasterCard, and Discover credit cards as well as electronic transfer for making payments. Payments by mail are not accepted.
SECURITY DEPOSIT
Your security deposit is required to confirm your reservation. The security deposit is held during your stay and refunded within one week of your departure, less a non-refundable $135 cleaning fee. Security deposit refunds are made after determination that upon departure you have left the unit and contents in the same condition they were upon arrival, and there are no outstanding charges i.e. extraordinary cleaning services, repairs, etc. that are not considered normal wear and tear, at which time it will be returned to you, less any charges, within one week from departure. If determined that smoking or pets were allowed inside the home, your entire security deposit will be forfeited. The cleaning fee will be subtracted from the security deposit. For example, if you get your total security deposit back, the refund will be $165: the $300 security deposit less the $135 cleaning fee.
RENTAL PAYMENT
Your rental payment must be paid in full no later than one week before your arrival date. Our website will automatically email daily payment reminders starting two weeks before your arrival date, until the rental charges are paid. Owner reserves the right to cancel your reservation if your rental payment has not been made one week prior to your arrival date and if we have another guest interested in the same time slot. Your security deposit will be refunded in full if this occurs.
CANCELLATION & REFUNDS
31 days or MORE before your arrival date - Security deposit will be refunded less a $10 processing fee.
30 days or LESS before arrival - Forfeiture of entire security deposit, unless cabin is re-rented for an equivalent period.
All requests for credit card refunds as a result of cancellation are subject to a 3% processing fee, or $10, whichever is greater.

Keys are located in a lock box located by the electrical box by the back door of the cabin, and your access code will be emailed to you.
RULES & REGULATIONS
In order to preserve the integrity of the home, we ask that it be occupied in a quiet and dignified manner, protecting the premises and its contents against damage, loss or theft with adherence to all the rules and regulations of the applicable Alta Sierra community and surroundings. Its property owners all inclusive will not be liable for any claims, suits, damages, costs, losses and expenses arising from injury to any person or property occurring on or about the premises relating to the rental of this property.

Renters and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:
A. Occupancy exceeding the maximum allowable, or as you stated and paid for on the reservation confirmation, without prior permission.
B. Use of tents, RVs, or any other outdoor sleeping accommodations on the property or the immediate vicinity without prior express permission from Owner.
C. Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age.
D. Causing damage to the premises rented or to any of the neighboring properties.
E. Any other acts which interfere with neighbors' right to quiet enjoyment of their property.
F. Unauthorized access and/or tampering of any storage facilities located on or within the premises. These facilities are NOT included in this agreement and are exclusively used by Owner.
This cabin does not have a fire pit , BBQ or a wood stove. No camp fires or fires of any type are allowed on or near the property.

DEPARTURES
The property must be vacated by 11:00 AM on the date indicated in order to make it available for future guests. Unless otherwise extended with agreement from Owner or Manager, the Owner or Manager shall have the right to take immediate possession of the unit at check-out time. When checking out:
1. Remove all bedding that was used and leave on bedroom floor. Leave used towels on bathroom floor. Do not remove unused bedding.
2. Dishes should be clean and put away.
2.Turn off all lights and fans.
3 Lock all doors and windows.
4. If using heat, put thermostat at 40.
5. Please return the keys to the lock box and scramble the combination.
TELEPHONE
The calling plan for the cabin's telephone allows for unlimited local and long distance use within the continental United States. Please do not make any calls outside the continental U.S.; otherwise, you are welcome to use the telephone freely at no charge. The area code is 760 and must be used even for other 760 numbers.
KEYS
You will enter the premises using a lock box, and the key inside the box is also for the basement to access the water heater if necessary, as well as sleds, snow shovels, etc. Replacement cost: $10 each
PETS
We love pets and have three of our own, but they are not allowed at Kamala. It is important not to violate this because some guests have pet allergies and we want the cabin to be allergy-free. Any pets found inside premises, or any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the lease and forfeiture of the Renter's entire security deposit.
HOUSEKEEPING
Housekeeping service during an extended stay is available for an additional fee of $25 per hour. You must notify the Manager when you would like the housekeeping completed. Housekeeping includes washing towels, linens, vacuuming, and making beds. It does not include personal items such as clothing. This housekeeping service is optional, and in addition to the normal departure cleaning fee.
CLEANING
The property will be inspected, sanitized and cleaned after your departure. The $135 cleaning fee you have paid with your deposit will provide for four hours of normal cleaning, laundry, and trash removal so you can enjoy your vacation up to the last moment. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure dishes are done and put away and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit. Bagged trash should be left in the trash bins on the porch with the lids securely fastened so animals cannot get into it. Excess trash may be left in the service hall or basement.
DISTURBING THE PEACE
Please respect our neighbors and properties. Many neighbors are permanent residents and we do our utmost to be respectful of them. SOUND CARRIES IN THE MOUNTAINS. When you shout or call out loudly to someone, it may be heard for many blocks. We thank you for being aware of that. Quiet hours are from 9pm to 8am Weekdays (Sun-Thu) and 10pm to 8am Weekends (Fri-Sun).
During Quite Hours, keep all noise levels down and visitors other than the renters and their vehicles should leave property.
Trespassing, consistent loud noises, fires or animals, or other actions that generate complaints from our neighbors are considered disturbing the peace. Should we receive a complaint from a neighboring property, the following procedure will be followed:
COMPLAINT PROCEDURE
FIRST COMPLAINT: You will be given a warning by phone. If a phone call is not successful, you will be visited personally by our manager and charged a $40 "call-out" fee, which will be withheld from your security deposit.
SECOND COMPLAINT: If you receive another warning call or service call fee, you will, in addition, be black-listed from renting any Co-op controlled vacation rental in the community.
THIRD COMPLAINT: Authorities will be called to the property for Disturbing the Peace under Penal Code 415, and you will be required to vacate the property in addition to forfeiting all rents and deposits.

WE ARE VERY CONCERNED ABOUT ANY DISTURBANCES ON OUR STREET. NO MORE THAN THREE (3) CARS ARE ALLOWED DURING YOUR VISIT AND MUST BE PARKED IN OUR SEMI-CIRCULAR DRIVEWAY OR OTHER PARKING AS DESIGNATED BY OWNER.
EXCESS NOISE THAT RESULTS IN COMPLAINTS FROM OUR NEIGHBORS WILL RESULT IN THE LOSS OF YOUR SECURITY DEPOSIT, AND AN INVITATION NOT TO RETURN.

ACCESS
ACCESSING OUR CABIN REQUIRES CLIMBING STAIRS FROM THE SEMI-CIRCULAR DRIVEWAY TO THE HOUSE. IF YOU ARE UNABLE TO CLIMB STAIRS, THIS MAY NOT BE THE PROPERTY FOR YOU. BUT THE REWARD IS THAT YOU ARE LOOKING AT THE MIDDLE AND TOPS OF TREES, NOT THE TRUNKS. THE DRIVEWAY MAY BE SLIPPERY WHEN WET OR ICY, OR WHEN COVERED WITH FALLEN LEAVES, SO PLEASE USE THE STAIRS AND HAND RAILS.
IF YOU HAVE FOUR-WHEEL DRIVE, YOU MAY DRIVE TO THE UPPER PARKING AREA TO UNLOAD. YOU MAY NOT REMAIN PARKED THERE BECAUSE THAT AREA IS OVER THE SCEPTIC TANK AND SHOULD NOT HAVE SUSTAINED HIGH WEIGHTS (SUCH AS CARS OR TRUCKS). PLEASE BACK DOWN CAREFULLY.
WINTER GUESTS - PLEASE READ THIS WARNING:
ALTA SIERRA RECEIVES SNOW EVERY YEAR - WINTER/SPRING WEATHER CAN BE UNPREDICTABLE, AND SNOW CAN START AS EARLY AS OCTOBER.
ALTHOUGH COMMUNITY ROADS ARE REGULARLY PLOWED -IT IS ESSENTIAL THAT YOU HAVE 4 WHEEL DRIVE AND CHAINS! ADDITIONALLY, THE CHAINS MUST BE ON THE VEHICLE IN ORDER TO NEGOTIATE THE "S" CURVE LEADING TO THE PROPERTY. REFUNDS/CREDITS WILL NOT BE GIVEN FOR WEATHER OR SNOW CONDITIONS! IF PROPERTY CANNOT BE ACCESSED YOU MAY HAVE TO PARK IN AN AREA NEAR THE GREENHORN GRILL (NOT AT THE GRILL) IN AN AREA SPECIFIED BY THE OWNER AND CARRY YOUR BELONGINGS THROUGH UNBROKEN SNOW TO THE CABIN. STAY ON ROADWAY - DO NOT WALK THROUGH OTHER PEOPLES' PROPERTY. IF A STORM HAS OCCURRED JUST PRIOR TO ARRIVAL, THE ROADS MAY NOT BE PLOWED YET AND YOU MAY HAVE TO PARK AND CARRY. THIS IS JUST PART OF LIVING IN A SMALL MOUNTAIN COMMUNITY. CREDITS WILL NOT BE GIVEN FOR WEATHER OR SNOW CONDITIONS!
WINTER DRIVING CONDITIONS IN THE MOUNTAINS CAN BE DANGEROUS - BE PREPARED!!!!!
ICE SHOES - FYI
THERE ARE "ICE SHOES" AVAILABLE FROM COMPANIES LIKE STABILICERS. THEY STRAP OVER YOUR SHOE WITH VELCRO AND HAVE METAL CLEATS ON THE BOTTOM. I NEVER GO ANYWHERE IN WINTER WHEN THERE MAY BE SNOW OR ICE WITHOUT MY STABILICERS.
IF YOU IGNORE THESE DIRECTIONS AND YOUR CAR SLIDES OFF THE ROAD AT THE "S" CURVE, IT WILL COST UP TO $500 TO CALL A TOW TRUCK TO REMOVE YOUR CAR. DO NOT ASK FOR HELP FROM NEIGHBORS OTHER THAN TO USE A PHONE IF NEEDED, SO PLEASE, FOLLOW THE WINTER DRIVING DIRECTIONS.
INTERNET
ALTA SIERRA KAMALA KABIN HAS WIRELESS INTERNET. BE AWARE THAT BECAUSE YOU ARE IN THE MOUNTAINS IN A RUSTIC SETTING, SERVICE MAY BE SPOTTY AT TIMES - DURING STORMS, IF THE SATELLITE IS BLOCKED BY TREES IN A HIGH WIND, ETC. YOU WILL HAVE TIPS ON HOW TO ACCESS IF YOU EXPERIENCE DIFFICULTY, BUT NO REFUNDS WILL BE GIVEN IF YOU ARE UNABLE TO ACCESS SERVICE.
ADDITIONAL TERMS AND CONDITIONS
By entering into this rental agreement, you hereby authorize the Owner of the Kamala Cabin to assess charges to your credit card for theft, excessive cleaning, or damages beyond normal wear and tear. In the event that theft or damage occurs, or excessive cleaning is required, a detailed accounting and invoice will be sent to you.
The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees, the prevailing party shall be entitled to recover reasonable attorney fees and costs.
